The rules of posting in a restaurant
Its time to start the new school year, and we would like to remind you of a few basic rules concerning the posting obligations in your establishment, and to take stock in order to start on the right foot!
The restaurant business is complex. In addition to the service and catering part, a lot of information must be brought to the customers attention, not only for the respect of the laws, but also because consumers are more and more vigilant and could very easily point out a failure on your part, which could cost you dearly...
Price display
An order of March 27, modified by order of June 29, 1990, stipulates that any establishment serving meals, food or beverages for consumption on the premises must clearly display the prices of its most commonly served food and beverages. The posted price includes taxes and service, and documents made available to customers such as menus must indicate "price including service" followed by the rate of service in brackets..
A distinction is made between indoor and outdoor advertising
1/Internal price display
The interior display consists of the indication, on a document posted in public view, of the list established by heading of the foodstuffs and beverages offered to the clientele, with the price of each of them, mentioning the nature and the capacity for beverages.
This display can be replaced by menu cards made available to each customer.
2/External price display
The exterior signage must be visible and legible to potential future customers, and must be installed throughout the duration of service, from 11:30 a.m. for lunch and 6 p.m. for dinner. It must be strictly identical to that served inside the establishment, on the cards. If menus are only served at a certain time of the day (for example brunch), this particularity must be clearly mentioned.
The restaurant's exterior signage must indicate the menu of the day, as well as your wine list or non-alcoholic beverages, with at least the price of 5 different wines served by the house (or the price of the wines if less than 5 are served).
The origin of the meat
All restaurants must indicate to their customers in a legible and visible way, on the menu cards or any other support, the origin of the pieces of beef or minced meat that they offer, by decree of September 17, 2002.
This is done either by displaying the origin of the meat (name of the country), when the birth, rearing and slaughter of the cattle from which the meat is derived take place in the same country, or by indicating the name of the country of birth or the country of rearing + the name of the country of slaughter when the birth rearing and slaughter take place in different countries.
Information sur les allergènes
The decree n°2015-447 of April 17, 2015 defines the modalities of information relating to the use in the manufacture or preparation of foodstuffs of any ingredient, processing aid or derivative of a substance or product, which may cause allergies or intolerances, and still present in the finished product, even in a modified form.
In other words, the restaurant professional will have to clearly indicate to the consumer the methods by which the customer will be able to access this information in written form.
No smoking
Signage at the entrance and inside the establishment must remind all consumers of the ban on smoking in the places mentioned in article R.3511-6 of the public health code.
Signage models must comply with the graphic provisions set forth in the Order of January 3, 2007.
Display of the liquor license and protection of minors
All licensed restaurant owners must display their license on their storefront.
It will also have to display the regulations on the repression of public drunkenness and the protection of minors (notably the prohibition of the sale of alcohol to minors under the age of 18), governed by theArticle L3342-1 of the Public Health Code, stipulating that the person issuing beverages may require the customer to establish proof of majority.
The offer, free of charge or in return for payment to a minor or any object directly inciting to excessive consumption of alcohol is also prohibited.
