General Terms and Conditions of Sale
1 - SCOPE OF APPLICATION
These General Terms and Conditions of Sale (GTCS) apply to all orders placed by individuals or professionals on the website www.chr-market-france.fr of CHR MARKET (Simplified Joint Stock Company with a capital of €7,500, 67B rue des Aubépines, 38280 Villette d'Anthon, registered with the Lyon Trade and Companies Register under number 823 250 162 and with EU VAT number FR 33 823250162) for the purchase of goods to be delivered in metropolitan France (excluding Corsica) (hereinafter referred to as the "Products").
Order confirmation by the buyer implies unconditional acceptance of these GTCS, which take precedence over all previous versions or communications from the buyer.
Important: Professional clients do not benefit from the right of withdrawal, except where specific legal provisions apply (Article L221-28 of the French Consumer Code).
2 - ORDERS
2.1 Product Offer
The Products are presented in accordance with legal requirements and as accurately as possible. Prices and specifications may be modified at any time due to supplier or raw material variations, without obligation to update products already delivered.
Only orders validated on the website and confirmed after payment are final. All prices are exclusive of tax, ex-works, with shipping and packaging costs in addition. Photos and illustrations are non-contractual and may slightly differ from the actual products.
2.2 Order Acceptance
An order is considered firm and final for the buyer upon validation on the website. CHR MARKET is only bound after payment validation and confirmation of order processing.
3 - PRICES AND PAYMENT
3.1 Product Prices
Prices are indicated in euros, excluding taxes, ex-warehouse. VAT is applied according to current legislation. Prices may change until the order is confirmed.
3.2 Delivery Fees
Delivery fees are calculated based on the method chosen by the Client and displayed before the final confirmation of the order.
3.3 Payment
Payment must be made in euros, in full at the time of order, by credit card, bank transfer, French bank cheque, PayPal, store credit, or gift card, unless otherwise stated.
If payment is not received within 15 days of order confirmation, the order may be canceled after written notification to the client.
CHR MARKET reserves the right to verify the identity and banking details of clients before delivery. Failure to respond to verification requests may result in order cancellation.
3.4 Retention of Title
In accordance with French law n° 80-335 of 12 May 1980, CHR MARKET retains full ownership of the goods until full payment of the price. Risk transfers to the buyer upon delivery to the carrier.
In case of non-payment, CHR MARKET may require the return of the goods at the client's expense.
4 – DELIVERY AND TRANSPORT
4.1 Delivery
Delivery times are indicative. Risk passes to the buyer upon delivery to the carrier. Delivery is made to the store threshold for professionals and to the residence threshold for individuals.
4.2 Delivery Delay
In case of delay, the Client must contact customer service. CHR MARKET cannot be held liable for loss of business, lost goods, or indirect damages related to the delay.
4.3 Receipt and Complaints
The Client must check the condition, quantity, and conformity of the packages upon delivery. Any claim must:
- Be noted on the delivery receipt with precise remarks,
- Be confirmed by registered letter with acknowledgment of receipt to CHR MARKET and the carrier within 48 hours of delivery.
Unsolicited returns without written agreement from CHR MARKET will not be accepted. Return costs for unjustified refusal are borne by the Client.
5 – PRODUCT WARRANTY
5.1 Warranty Period
All products benefit from a legal warranty of 1 year on parts and labor, or as indicated on the product sheet (manufacturer's warranty). Labor may be excluded beyond the first year.
5.2 Intervention Procedure
For large equipment (refrigerated display cases, back bars, etc.), the choice of intervention method is at the sole discretion of CHR MARKET, according to the solution most economically advantageous for the company, without the Client’s right to oppose.
Interventions may include:
- Technician intervention appointed by CHR MARKET, near or remote from the site,
- Intervention by a technician proposed by the Client, subject to written approval by CHR MARKET,
- Return of the equipment for repair at our facilities or a designated service center.
All travel, labor, and transport costs remain the responsibility of the Client, unless otherwise agreed in writing.
Unauthorized interventions or repairs by the Client do not entitle any reimbursement or compensation.
The warranty never covers indirect losses, business interruption, or damage to goods.
5.3 Warranty Limitations
The warranty does not cover:
- Regular wear parts (glass, seals, filters, bulbs, etc.),
- Failures due to poor maintenance, improper use, or unsuitable environment,
- External damage: impact, fall, fire, flood, lightning, theft, etc.,
- Cosmetic damage: varnish, lacquer, paint.
Proof of malfunction may be requested by CHR MARKET.
6 – WITHDRAWAL
6.1 Period
Individuals have a legal period of 14 days to exercise their right of withdrawal, from receipt of the product, provided it is complete, unused, and in its original packaging. Spare parts, hygiene products, or custom-made products are not returnable.
Professionals do not have this right, except where specific legal provisions apply.
6.2 Refund
Returns must be reported to customer service and comply with packaging and protection requirements. Return costs are the Client’s responsibility.
CHR MARKET will refund compliant returned products within 14 days via the original payment method.
In exceptional cases, where a return is accepted outside the contract terms and conditions, a depreciation of 30% of the product price will be applied.
7 – JURISDICTION
The Client is responsible for product selection and compliance with legal and safety standards applicable to their activity. CHR MARKET cannot be held liable for damage resulting from misuse, improper installation, or malfunction of the products.
In case of dispute, only the courts of CHR MARKET's registered office are competent. CHR MARKET's liability is limited to the order amount.
